BOA 10/25/01 Minutes <br /> Page 4 <br /> Finding of fact: <br /> 1). Applicant has constructed a 75' x 70' barn addition without necessary zoning <br /> permits. <br /> 2). Barn addition is located 56.4 feet from centerline US Highway 14,requiring a <br /> variance of 53.6 feet. <br /> 3). Previous 70' x 81' barn addition approved 11/17/83 (Variance#1211) allows existing <br /> setback 55 feet to centerline US Highway 14. <br /> 4). Applicant has limited buildable area due to highway right-of-way to the North and <br /> railroad right-of-way to the South. <br /> 5). Project is to cover and enclose a barnyard run-off project designed and built by <br /> Dane County Land Conservation Department. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried- 4-0. <br /> #3160. Appeal by Icke Construction Company, Inc. to appeal the Interpretation of the <br /> Dane County Zoning Administrator as it pertains to parking and storing of motor vehicles <br /> tiv as provided by Section 10.14(1)(q), Dane County Code of Ordinances. <br /> IN FAVOR: P. Icke OPPOSED: COMMUNICATION:Town Board <br /> Sayles/Long to sustain in the Zoning Administrator's Interpretation of Section <br /> 10.14(1)(9) of the Dane County Code of Ordinances, and rule against the applicant's <br /> appeal. <br /> Finding of fact: <br /> 1). Section 10.14(1)(9)Dane County Code of Ordinances permits: "Parking and storage <br /> of motor vehicles," however, the Zoning Administrator has interpretated that to mean <br /> operable and currently licensed vehicles. <br /> 2). Section 10.01(28) defines an inoperable or unlicensed vehicle as junk. <br /> 3). Section 10.20(1) Dane County Code of Ordinances salvage recycle centers (1) use. <br /> for the purpose of this ordinance, any premise used for the storage, gathering, recycling <br /> or sale of junk, as defined in this Chapter, is a salvage recycling center. <br /> 4). Applicant proposes C-2 Commercial property to be utilized for storing; abandoned, <br /> unlicensed or inoperable vehicles picked up by a towing company under contract to City <br /> of Madison. <br /> 5). An ordinance amendment, if approved could accommodate applicant's desired usage <br /> or rezone and C.U.P. in the C-1 district. <br /> Conclusion: <br /> The Dane County Board of Adjustment concludes that the Zoning Administrator's <br /> Interpretation is a reasonable reading of the Ordinance. Motion carried 3-1.(Klopp —no.) <br />
