Appeal by Marie Hustad for a variance from required setback from road as <br /> provided by Section 10.17(4)to permit addition to existing residence at 101 Oakwood <br /> Avenue being Lots 31 and 32,Block#3, Highwood Estates, Third Addition, Section 36, <br /> Town of Albion. <br /> IN FAVOR: M &M Hustad OPPOSED: --- COMMUNICATION: <br /> Town Board <br /> KAY/SAYLES to grant variance of 5.2 feet from required setback to right-of-way of <br /> Oakwood Avenue to permit roofline alteration only to existing residence and to deny <br /> Cor variance from required setback from road for any new construction which enlarges the <br /> footprint. <br /> Finding of fact: <br /> 1). Applicant proposes to almost double the size of existing 2 story residence. <br /> 2). The existing residence located 14.8 feet from right-of-way line needing a variance of <br /> 5.2 feet. <br /> 3). Surrounding properties have been granted variances for setback from road however, <br /> the projects were not of this magnitude, (#1602-8/87 & 1762-9/88). <br /> Conclusion: <br /> STRUCTURAL ALTERATION: 1). Variance preserves the zoning ordinance as much <br /> as possible without injustice to applicant. 2). Variance is not contrary to rights of others <br /> or to the public interest. <br /> NEW CONSTRUCTION: 1). Unnecessary hardship was not proven. <br /> Motion carried ;>0 R A46$4) <br /> #3143.
