Appeal by John & Judy Thomas for a variance from required <br /> setback from road as provided by Section 10. 17 (2) to permit new <br /> residence construction at 2248 County Highway AB being Lot #7, <br /> Washington Park, Section 23, Town of Dunn. <br /> IN FAVOR: J & J Thomas OPPOSED: --- COMMUNICATION: County <br /> Highway, Town Board. <br /> SAYLES/KAY to grant, with condition, variance of 11 feet to <br /> required setback to County Highway AB right-of-way to permit new <br /> residence construction as proposed. <br /> Condition: <br /> 1) . The residence shall be removed at the owner' s expense if <br /> future road improvement requires additional right-of-way. <br /> Finding of fact: <br /> 1) . Applicant has residential lake lot with old cottage on <br /> presently, and proposes to raze cottage and construct new <br /> residence. <br /> 2) . Buildable area is limited by setback from Lake Kegonsa on <br /> the East and setback from right-of-way of County Highway AB on <br /> the West. <br /> 3) . Section 10.17 (2) Dane County Code Of Ordinances required <br /> setback from County Highways is the greater of 75 feet from <br /> centerline or 42 feet to right-of-way line. <br /> 4) . County Highway was relocated away form subject property and <br /> centerline is 100 feet from closest point of proposed <br /> (IW <br /> construction. <br /> 5) . Property is in an area of numerous non-conforming <br /> structures with numerous variances granted. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) .
