That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals. <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> I inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . That rain gutters and downspouts be directed to keep <br /> water on applicant' s property and discharge on down gradient <br /> side of residence. <br /> 8) . Permit valid August 28, 1998 and certification and <br /> completion deadline of September 15, 1998 . <br /> FINDING OF FACT: <br /> 1) . Applicant has residence under construction (ZP 1998- <br /> 1741) on a very steep lot which is partially within 300 feet <br /> of Lake Waubesa. <br /> 2) . Project is designed to provide efficient storm water <br /> drainage without impacting adjoining properties. <br /> 3) . Morris Park Road lies between subject property and Lake <br /> Waubesa. <br /> 4) . Engineering provided by Nickolas George, Professional <br /> Engineer <br /> fiv CONCLUSION: <br /> 1) . 1) . The project as planned, with specified conditions; <br /> will not result in substantial detriment to navigable waters <br /> by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions. Motion carried - <br /> 5-0. <br /> #2973. Appeal by Richard and Gayla Divelbiss for a Special <br /> Exception Permit as provided by Section 11.05 (3) to permit <br /> filling, grading, etc. , within 300 feet of Lake Mendota at 4405 <br /> Fox Bluff Lane being Outlot #14, Assessor's Plat of Fox Bluff, <br /> Section 5 South Town of Westport. <br /> IN FAVOR: P. Saiki, R. Divelbiss, S. Whayland, P. Fortlage <br /> OPPOSED: --- COMMUNICATION: Town Board, Department of Natural <br /> Resources, Regional Planning Commission. <br /> KLOPP/ROSS to grant, with conditions, permit to fill, grade and <br /> retaining walls as per revised plan to be submitted. <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances. <br />
