Section 10.255 (3)(a) <br /> provides that the zoning committee may impose restrictions on the property to <br /> be rezoned but does not providee this same authority to the committee <br /> regarding the land remaining outside of the zoned area. Therefore, <br /> restrictions as proposed by your town board will have to be implemented by <br /> agreement between the Town and the applicant. <br /> I have enclosed a deed restriction document which may be used to record <br /> the restrictions the Town wishes to impose. The document is a revision <br /> of our regular document which was drafted by the Dane County Corporation <br /> Counsel for the purpose of restrictions imposed by the county. I <br /> suggest that you have your attorney and the property owner's attorney <br /> review the document to assure that the revised wording is what you both <br /> intend it to be. <br /> The description of the property on which the restrictions run should be <br /> typed in on the first page in the appropriate place under Item 1. The <br /> description of the property could be obtained from the tax bills and <br /> should include the parcel number, 1/4 1/4 and pertinent section. See <br /> the following example. <br /> Parcel #0712-284-9574, Part of the SE 1/4 SE 1/4, Section 28 <br /> Parcel #0712-283-0000, The NE 1/4 SW 1/4, Section 28 <br /> Etc. <br /> The proposed restriction/s should be typed in under Item #3. <br /> The next work meeting of the zoning committee will be on March 26, <br /> 1991. If this matter has been resolved and the restrictions recorded to <br /> the Town's satisfaction, you can inform me and I will advise the Zoning <br /> Committee. The petition could then be referred to the County Board for <br /> action on April 4, 1991. If the restrictions have not been recorded in <br /> time for the committee's work meeting you could request that the. <br /> committee hold their action until the document has been recorded. <br /> If you have any questions please contact me. <br />
