Box 1807 KORNSTEDT <br /> Madison, Wisconsin 53701-1807 <br /> Re: Deed Restrictions/Proposed Greyhound <br /> Racing Facility (Town of Rutland) <br /> Dear Bill: <br /> Thank you for your letter of January 30, 1989, which we <br /> received on January 31, 1989, along with a copy of your revised <br /> deed restrictions. <br /> As legal counsel for the Town of Rutland, I have reviewed the <br /> revised deed restrictions and have the following comments: <br /> 1. Legal Description. I took the legal description for the <br /> deed restrictions from the deed restrictions and conditional use <br /> permit for the Impact Speedway property. I assume that the <br /> property which Rutland Greyhound Park, Inc. proposes to use is <br /> exactly the same parcel as previously covered by the deed <br /> restrictions. <br /> You, however, as attorney for the applicant, are in the best <br /> position to verify that the legal description used in the deed <br /> restrictions is accurate and covers the entire parcel to be owned <br /> by Rutland Greyhound Park, Inc. I would ask that you verify in <br /> writing that the legal description in the deed restrictions <br /> document is accurate and complete. <br /> 2. Signature Page. The deed restrictions will be recorded. <br /> Consequently, the signatures will need to be authenticated, as <br /> required in section 706. 05, Wis. Stats. I will also want an <br /> express statement that the officers signing on behalf of Rutland <br /> Greyhound Park, Inc. are authorized to execute this document on <br /> behalf of the corporation. Dates of signing should also be added. <br /> 3. Evidence of Title. We will need to know that at the <br /> time of executing the document, Rutland Greyhound Park, Inc. is <br /> the sole owner of the parcel. Accordingly, please provide satis- <br /> factory evidence of title before the document is executed. <br />
