Finally, as the Town has stated previously, and you <br /> and your clients have agreed, it is the continued position of the <br /> Town that one or more written agreements will need to be entered <br /> into between the Town and your clients regarding the various <br /> financial and operational commitments made by your clients in <br /> connection with development of the racetrack. The Town's <br /> agreement with the rezoning or the execution of the deed <br /> restrictions does not in any way waive the Town's condition that <br /> such additional agreements are necessary before the racetrack <br /> operation can proceed. <br /> 5. No Waiver of Conditional Use Permit Process. I agree <br /> with Dane County Corporation Counsel Cal Kornstedt's statement <br /> that the entering of the deed restrictions does not waive the <br /> County's requirements regarding the conditional use permit <br /> process. In fact, it is the position of the Town of Rutland that <br /> any conditional use permit issued for this parcel must incorporate <br /> by reference the deed restriction document in its entirety.
