Enforcement may be by injunction or <br /> other available remedy at law or equity ( including but not <br /> limited to monetary damages and ordinance enforcement) against <br /> any party who has or acquires an interest in the Parcel: <br /> 1. Dane County, Wisconsin, or its successor if Dane County <br /> no longer has zoning jurisdiction over the property described <br /> herein, provided that the lands are under the jurisdiction of <br /> a zoning ordinance of some such jurisdiction at the time the <br /> enforcement action is commenced; <br /> 2. Town of Rutland, Dane County, Wisconsin, provided that <br /> the lands are within the governmental jurisdiction of said <br /> town at the time the enforcement action is commenced; and <br /> 3 . The owners of record of any lands located with/3Z feet <br /> of the Parcel at the time of the alleged violation of the <br /> restrictions. <br /> C. Amendment/Termination. These restrictions may be <br /> amended or terminated in the following manner : A written <br /> petition calling for the amendment or termination of the <br /> restrictions may be made by person(s) who are, at the time of the <br /> petition, owner(s) of the Parcel subject to these restrictions . <br /> Such petition shall be submitted to the Rutland Town Clerk and to <br /> the Dane County Clerk who shall refer the petition to Dane <br /> County' s AELR Committee (or successor committee) , which committee <br /> shall schedule and hold a public hearing on the petition in the <br /> same manner as public hearings for zoning amendment petitions are <br /> noticed and scheduled.
