reject the petition. Any amendment or termination of these <br /> restrictions shall also require the prior written approval of the <br /> Rutland Town Board. If approved, the petitioner (s) shall draft <br /> the necessary legal instrument, subject to the town and county' s <br /> approval, and have it executed by the owner(s) of the Parcel and <br /> recorded. Nothing contained herein shall be construed to limit, <br /> abridge or modify in any manner whatsoever rights and privileges <br /> afforded by statute relating to amendment of zoning ordinances. <br /> D. Costs. Owner shall reimburse the Town of Rutland for <br /> all costs incurred by the town in connection with the preparation <br /> and review of these deed restrictions or any subsequent <br /> amendments or termination thereof, as well as all costs incurred <br /> by the town in seeking the enforcement of these restrictions at <br /> any time. Such costs may include but are not limited to actual <br /> attorneys ' fees, actual engineering fees and town administrative <br /> costs. Owner shall reimburse the town in full for such costs <br /> within 30 days of receipt of billing from the town. <br /> E. Security for Payment . Owner agrees that it will be <br /> obligated to pay or reimburse the Town of Rutland or the County <br /> of Dane for various costs in connection with the dog racing <br /> activity, including, but not limited to, road improvements, <br /> traffic control, signage, plan review, and deed restriction <br /> amendment and enforcement . it is further agreed that it is <br /> intended that Owner , not the Town of Rutland or County of Dane, <br /> bear such costs.
