Section II : Fencing Required : Property owners or those <br /> occupying or using hazardous areas with the property owner ' s per- <br /> mission , shall fence all hazardous areas within 30 days of the <br /> effective date of this ordinance . <br /> In order to comply with this section , fences must be ( 1 ) <br /> not less than 4 feet in height ; ( 2 ) be constructed of the wire <br /> material commonly known as "cyclone fence" or other substantial <br /> material with similar strength and openings no larger than those <br /> existing on " cyclone fence" ; ( 3 ) be located not less than ten <br /> feet from the property line of the hazardous area ; and ( 4 ) be of <br /> sufficient length and contour to completely deny access to the <br /> upland edge of the slope existing in the said hazardous area . <br /> Section III : Penalties for Violation : Any person who <br /> fails to comply with this ordinance shall forfeit not more than <br /> $ 100 . 00 for the first offense , $200 . 00 for the second offense and <br /> $500 . 00 for the third and all subsequent offenses . No person may <br /> be charged with violation of this ordinance more than once - in-' any <br /> 30 day period . <br /> Section IV : This Ordinance shall take effect upon its <br /> passage and posting in accordance with law . <br /> Adopted by the unanimous approval of the Town Board of the Town <br /> ___o_f.
