i <br /> including proposed exterior elevations , finish contours, <br /> driveways , exterior lighting, loading and parking areas , and <br /> existing trees or trees to be planted and until the final <br /> plans and specifications for the proposed improvement have <br /> been approved in writing by the Review Board (see Addendum <br /> attached hereto) . Said preliminary rendering, general <br /> landscape plan and final plans and specifications are to be <br /> signed by the owner of the subject land. <br /> B. BASIS FOR APPROVAL. Approval of the architectural design of <br /> the proposed improvement and the landscaping plan shall be <br /> based on adequacy of site dimensions , aesthetically pleasing <br /> external design and relation of topography, grade and finish <br /> ground elevation of the site being improved to that of <br /> neighboring sites . Approval of the final plans and <br /> specifications for the proposed improvement shall be based <br /> solely on whether said final plans and specifications are <br /> consistent with said preliminary plans . The Review Board <br /> shall not withhold its approval of any architectural design <br /> of a proposed improvement, any landscaping plan, or any <br /> final plans and specifications which substantially comply <br /> with the concept and intent of Article I and this <br /> Subparagraph IVB. <br /> C. RESULT OF INACTION . If the Review Board fails either to <br /> approve or disapprove documents submitted to it pursuant to <br /> these declarations within forty-five (45) days after the <br /> same have been submitted to it, it shall be conclusively <br /> presumed that the Review Board had approved the same; <br /> -4- <br />
