DANE COUNTY ORDINANCE AMENDMENT NO. 7596 (g6 J <br /> Amending Section 10.03 relating to Zoning Districts in the Town of York. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of York be amended to include in the A-2(4) Agricultural District/s the <br /> following described land: <br /> PETITION NUMBER/C.U.P. NUMBER: 7596/1576 <br /> Part of the SE 1/4 SE 1/4 and SW 1/4 SE 1/4 Section 33, Town of York described as <br /> follows: Commencing at the Southeast corner of said Section 33;thence West, 1076.66 <br /> feet to the point of beginning; thence continue West, 809.90 feet; thence North, 586.43 <br /> feet; thence S52°25'36"East, 106.19 feet; thence S75°32'00"East, 322.97 feet; thence <br /> S84°03'22"East, 415.25 feet; thence South, 398.00 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner <br /> or owners of the land shall record the following restrictions on said land: <br /> 1.Balance of acreage to remain with farm due to unlimited livestock to allow for manure disposal;and <br /> 2. The following CUP uses, as derived from the Dane County Code of Ordinances s. 10.126 (3), Conditional <br /> Uses Permitted in the A-2 District: <br /> (o) kennels,horse boarding stables,riding stables,hay and sleigh rides,horse shows and similar events; <br /> (p) unlimited livestock on 3 to 16 acres; <br /> (q) sale of agricultural and dairy products not produced on the premises and incidental sale of pop and <br /> candy, <br /> (s) retail sales of bridles,saddles,grooming supplies and related items at a horse boarding or riding <br /> stable facility(said use shall be limited to a maximum of 150 sq.ft of floor space);and <br /> training of dogs at a dog kennel or training of horses at a horse boarding facility. <br /> 3.Erosion control plan for the proposed 46,400 s.f stable and indoor riding area,if built,to be approved by the <br /> Dane County Land Conservation Department. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
