BACKGROUND <br /> A. Request <br /> Jim Murphy is applying for a conditional use permit (CUP) on his 0.76 acre parcel to: (1) bring into <br /> conformance the existing tavern use; (2)bring into conformance existing, seasonal outdoor entertainment <br /> (e.g. the annual Riley Fest and the seasonal blue-grass music performances); and (3) to allow for outdoor <br /> games such as horseshoes, volleyball, or similar activities to be lighted and operate at night. The Riley <br /> Tavern has been in operation at this site for over 50 years, but has never had a CUP for either the tavern <br /> use or the annual Riley Fest that occurs on the third Saturday of every August. This petition is a good <br /> faith effort on the part of the applicant to bring the current operation into compliance. Furthermore, the <br /> applicant is seeking to expand the activities on the site to include a lighted, outdoor volleyball court, a 39- <br /> stall concrete parking lot, and a 3,575 s.f. garage that will include an 845 s.f. area to be used as an <br /> expansion of the existing tavern use that "would permit food service and sales of individual <br /> beverages during those times of the year when outdoor entertainment activities are provided (e.g. <br /> Riley Fest and the blue-grass music performances)." Attachment A graphically depicts the subject <br /> property and lands immediately surrounding it. Attachment B is the submitted site plan ("CUP Map") <br /> for this petition. Attachment B has been reduced in size to fit on an 8 '/z x 11 sheet of paper, so the noted <br /> scale is not accurate as presented. <br /> B. History/Past Actions <br /> On July 12, 1999, the Town of Springdale acted on and approved the conditional use for the <br /> grandfathered tavern. At its July 12 and July 19, 1999 meetings, the Town also acted on the conditional <br /> use to allow for outdoor entertainment, but only as it relates to the Riley Fest to be held this year on <br /> Saturday, August 21, 1999. The Town included conditions to be applied to this year's Riley Fest. More <br /> town action on this petition is expected at a joint meeting of the Town Board and Plan Commission on <br /> Monday, July 26, 1999. Although a town action report on this petition has been submitted and received, <br /> the town has indicated that its action on this petition is not yet complete. <br /> In regard to other relevant history, a quit claim deed was recorded in 1996 that transferred an area of land <br /> approximately 7,400 s.f. in area adjacent and contiguous to the northern boundary of the Murphy <br /> property and within the Klevenville-Riley Road right-of-way from the Town of Springdale to Jim and <br /> Nancy Murphy. Formerly, the front porch and parking area for the tavern extended into the Klevenville- <br /> Riley Road right-of-way. The quit claim deed transfer expanded the parcel size from about 26,639 s.f. <br /> (0.61 ac.)to the current area of 33,070 s.f. (0.76 ac.) and allowed for the existing front parking and porch <br /> to be entirely contained within the legal boundary of the property. Other properties in the area of the <br /> Sugar River Station Plat along Klevenville Riley Road appear to have been similarly adjusted, but have <br /> not yet been reflected in the County's GIS parcel coverage, so Attachment A does not accurately reflect <br /> all the parcel line changes in this particular area. <br /> Dane County Planning and Development Department <br /> Staff Report for Petition No. 1577 Page 1 of 5 <br />
