Docket 9170-RX-343 <br /> 2. Schwartz Road is a town road 22 feet wide and intersects the WSOR tracks at 90 <br /> degrees and USH 14 at 90-degrees north of the tracks. <br /> 3. The centerline of the tracks is 82 feet south of the USH 14 centerline. <br /> 4. The speed limit on Schwartz Road is unposted. <br /> 5. The average daily traffic (ADT) on Schwartz Road is expected to be less than <br /> 189. <br /> 6. The Schwartz Road crossing is protected by crossbucks; one STOP sign south and <br /> one YIELD sign north of the tracks; and, advance warning signs, one at each USH 14 approach <br /> and one on Schwartz Road south of the crossing. <br /> 7. The existing warning devices are adequate for the amount and speed of vehicular <br /> and train traffic at the crossing. <br /> 8. It is reasonable to establish the Schwartz Road crossing as a public crossing. <br /> 9. It is reasonable that the WSOR permanently remove the private crossing 475 feet <br /> west of the Schwartz Road crossing at the railroad's expense. <br /> Conclusions of Law <br /> 1. The WSOR is a railroad as defined in Wis. Stat. § 195.02(1.). <br /> 2. The Office has authority under Wis. Stat. § 86.12,Wis. Stat. § 189.02, Wis. Stat. <br /> §§ 195.03, 195.04, 195.06, 195.28, 195.285, 195.29, 19.5.30, Wis. Stat. § 227.47(1), and Wis. <br /> Admin. Code §§ RR 1.15,to issue this final decision authorizing establishing a public crossing. <br /> Opinion <br /> OWH owns and operates a self-storage facility with one existing self-storage building <br /> and 220 outdoor storage spaces south of the tracks.
