Docket 9170-RX-343 <br /> and the other property owner served by the driveway have entered into a recorded Joint Road <br /> Agreement and mutual easements to construct a private driveway connecting to Schwartz Road. <br /> The small amount of traffic using the OWH private crossing would then use the Schwartz Road <br /> crossing. <br /> Second,the proximity to USH 14 was deemed a dangerous condition if vehicles queued <br /> from the crossing onto USH 14. While queueing at USH 14 may still occur,6 there are <br /> acceleration/deceleration lanes for accessing Schwartz Road and the number of thru trains is half <br /> what it was in 2000.7 <br /> Moreover,the proposed development in 2000 would have resulted in 1695 ADT <br /> compared to 169 to 189 under the current development proposal. Thus,the likelihood that <br /> vehicles would routinely queue over the tracks from the USH 14 intersection is significantly <br /> reduced. <br /> Closing the private driveway and reconstructing the Schwartz Road crossing as a public <br /> crossing will adequately protect and promote public safety. <br /> Sight Distances <br /> The posted speed limit on USH 14 is 45 mph. The speed limit on Schwartz Road is <br /> unposted. However, under Wis. Stat. § 346.57(4)(h),the default is 55 mph. Given the short <br /> length of Schwartz Road (950 feet) and its close proximity to USH 14,however, speeds are <br /> much lower. Thus, it is reasonable to use 25 mph as a speed limit. <br /> 6 The WisDOT predicts severe congestion on USH 14 at and about Schwartz Road in 2030. (PSC REF#:304276) <br /> But see PSC REF#:305013 at 2 where the WSOR states that since 2005,carload traffic on the Prairie Subdivision <br /> has increased 450 percent and is expected to increase another 200 percent over the next five years based on market <br /> conditions and customer expectations. <br /> 4 <br />
