1. Such fees shall be waived if the land for which a Special Exception permit or <br /> a Variance from the ordinance is sought is owned by any municipality and the <br /> application is made by the governing body of that municipality. <br /> (7) DISPOSITION OF FEES <br /> (a) Fees collected under this section by the Zoning Administrator shall be accounted <br /> for and paid into the general fund of Dane County as are other moneys collected <br /> by the County. The Zoning Administrator shall issue a receipt for each fee <br /> collected. <br /> (b) Any fee collected by the Zoning Administrator, once paid, is not refundable. <br /> (8) CERTIFICATE OF COMPLIANCE <br /> (a) No building or addition thereto, constructed after the effective date of this ordi- <br /> nance and no addition to a previously existing building shall be occupied, except <br /> accessory buildings used exclusively for farming or agricultural purpose and no <br /> land vacant except that used exclusively for farming or agricultural purposes on <br /> the effective day of this ordinance shall be used for any purpose until a certifi- <br /> cate of compliance has been issued by the County Zoning Administrator. Every <br /> certificate of compliance shall state the use and occupancy and the location of <br /> the building or buildings or use of land complies with all of the provisions of -- <br /> this ordinance. <br /> (b) Every application for a zoning permit shall be an application for a certificate <br /> of compliance. <br /> (c) An application for a certificate of compliance for a new use or a change in use <br /> of land or a building shall be made directly to the Zoning Administrator. <br /> (d) No certificate of compliance for a building or addition thereto, constructed after <br /> the effective date of this ordinance shall be issued until construction has been <br /> substantially completed and the premises inspected and certified by the Zoning <br /> Administrator to be in conformity with the specifications on which the permit was <br /> issued. The Zoning Administrator may establish rules by which a temporary certi- <br /> ficate of compliance may be issued for a part of a building. <br /> (e) Any person, firm or corporation having a legal or equitable interest in a property <br /> which is non-conforming as to use or building location may request a certificate <br /> of compliance. Said applicant shall present documentary proof that said use was <br /> a permitted use at the time it originated or that the building has been erected <br /> prior to the adoption of this ordinance and was made non-conforming by the adoption <br /> of this ordinance or amendment thereto. After certifying that the use of building <br /> or land are in fact non-conforming the Zoning Administrator shall issue a certifi- <br /> cate of compliance stating the use in question or the location of buildings and the <br /> zoning of the property. <br /> 1. For certificate of compliance for new construction, additions, alterations or <br /> remodeling for which a Dane County Zoning Permit has been issued since August <br /> 20, 1970, there shall be no fee charged. For all other certificates of compli- <br /> ance, there shall be a fee of $5.00 for each certificate. <br /> (9) PENALTIES <br /> (a) Any person or persons, firm, company or corporation either owner, occupant or <br /> other user of the premises, who violates, disobeys, omits neglects or refuses <br /> to comply with or resists the enforcement of any of the provisions of this ordi- <br /> nance shall be subject to a forfeiture of not less than five dollars, nor more <br /> than two hundred dollars and costs. Each day that a violation is permitted to <br /> exist shall constitute a separate offense. Compliance herewith shall be enforced <br /> by injunctional order at the suit of the County or occupant of real estate within <br /> the the district affected by the regulations of this ordinance. It shall not be <br /> necessary to prosecute for forfeiture before resorting to injunctional proceedings. <br /> (b) Any person who has the ability to pay any forfeiture entered against him under <br /> this ordinance but refuses to do so may be confined in the County jail until such <br /> forfeiture is paid, but in no event to exceed thirty (30) days. In determining <br /> whether an individual has the ability to pay a forfeiture, all items of income <br /> and all assets may be considered regardless of whether or not such income or assets <br /> are subject to garnishment, lien or attachment by creditors. <br /> - 44 - <br />
