Highway 712`fron-tts intersection <br />with U.S. Highmrays 712 -,u-..d = -- 8 in Sec. 36, T7N, R9E, westward and <br />northward to its intersoction vdth U.S. Hijhzvay 712 in Sec. 2, <br />T7N, M.. <br />Tho 'proposed relocation. of State Trunk Highway 7113 fron the south- <br />east corner of the .villar,o limits of Waunakee, southoastorly to the <br />north linits of the City of Madi -son. <br />(2) Class "B" highways: All hirlwtiuys in Danc County not otherwise narkod <br />or classified, except 'streets less than sixty -six (66) foot wide platted in <br />subdivisions recorded previous to the passai;o of this ordinance, are hereby <br />dosigna•tod'as Class "B" highways'. For all Class "B" highways, setback lines <br />located parall`cl to and distant sovonty -fivo (75) foot fron the center line of <br />the highway are hereby established. <br />In no' case shall the setback, lines in. Class '14'41' or Class' "B" highveyas bo .lo- <br />cated less than forty -two (42) feet fron the hir,htivay right of way lino.• <br />Where the location of two or rlore highvrays'of different classifications are <br />coincidental, the greater setback shall apply. <br />SECTION X --NON- CONFORKI NG USES: <br />The lawful use*-of any buildinL or prorlisos existing at the time of the adoption <br />of this ordinance,"although such use coos not conform to the provisions hereof, <br />may be continued, but if such non- connoming use -is 'discontnuod, any future use <br />of the said.building or pronises shall be in conformity with the provisions of <br />this ordinance. <br />The non - conforming use of a building or prom-isos ray be changod to another <br />non - conforming use of-the sane or a higher classification. Whenever a, non - <br />conforninE use of a building; br proniso,- has boon changed to a more. restricted <br />use, such use shall not thereafter be changed to a loss restricted use. <br />Who district boundaries or regulations shall hereafter be changed, any <br />then existing non- conforrdng use in sucya .:bo continued or <br />changed to a use perratted in the .sai:ie district as that in which the existing use <br />is pornittod, provided that all other rc�ulations govering the new use are com- <br />plied with. <br />Ir-modiately after the passage and plublication of this ordinance, the County <br />Board of Supervisors shall cause to be nade a rocord of all non - conforming uses <br />in accordance with subsection seven (7)•of Section 59.97 of tho "Wisconsin <br />statutes .as' c .ondod by the laws of 1935. <br />SECTION XI - C011PLETION JUM RESTORATION OF EXISTING BUILDINGS <br />Nothing herein contained shall require any char�go in the plans, construction <br />or intended use of a building for which plans have beer_ prepared heretofore and <br />the construction of which shall have been diligently prosecuted within one (1) <br />month after the date of passago of this ordinance, and the ground story franowork <br />of which, including, the second tier of beaa:is, shall have been completed within <br />six (6) months after the date of passage of this ordinance. <br />Nothing herein contained shall prevent the restoration of a building destroyed <br />by fire, explosion, act of God or act of tho public enemy subsequent to the <br />passago of this ordinance; except that a non - conforming use so destroyed, to the <br />extent of fifty (500) percent or noro of its assessed valuation; according to the <br />assossment for the fiscal year in *hich such destruction occurs, shall, from and <br />after the.irate of such destruction,-.'conform to all of the rcgulations of the <br />district in which it is located. <br />SECTION XII - BOUNDlLRIES OF DISTRICTS <br />. In unsubdiviJed property, unless otherwise indicated bn the map, the district <br />boundary lines are the center lines of streets, highways, railroads, section lines <br />or quarter section lines or such lines extended. Where district boundary lines <br />are indicated,as adjacent and parallol-or approxii_urtely parallel to street, high -. <br />way or railroad lines,' such district boundary lines shall be assumed to be not <br />less than three hundred, (300) feet from the nearest right -of -way line noasured <br />at right angles to such right- of -vja.y line. . I <br />Where uncertainty exists with respect to the boundaries of the various districts <br />shown on the map .accok4panyino and made a part of this ordinance, such boundaries <br />shall be detorrdnod by the use of the scale contained on such nap. <br />
