<br />In interpreting and applying ti?e. provisions ,of this,-ordinance,,- be

<br />existing easements, covenants, or other agreements bctiveen parties, nor-is it
<br />intended by ,this ordinance to' repeal, abrooato, arnu1. or in any way to impair or
<br />interfere,`with any existing prozrisioiis of law or. ordinance or - any•rules, regula-
<br />/tions or, permits previous) -y adopted, or issued,- or. which shall be adopted or
<br />issued pursuant to law,,rElating to the use of buildings or premises; provided,
<br />however, that where this, ordinance imposes a .greater restriction upon the use
<br />of buildings'or premises than is- 'imposed or required by such existing provision
<br />of law or ordinance or by such rules, regulations, agreements, covenants, or
<br />permits, the provisions of this ordinance shall control.
<br />Nothing herein contained shall be con.struod'to prohibit the permitted use of
<br />promises 'or the oroction'or alteration of buildings for uses permitted in the
<br />various .districts on, a single lot or tract'of land of. loss area than. is',roqui -red .

<br />is located; Providod, that such single lot or tract of land was recorded as such

<br />SECTION XZV BOARD OF ADJUSTibIENT
<br />There shall'bo a board of adjustment consisting of throe (3) members to be _
<br />appointed by.tho chairman = of the county board with tho, approval of the county board
<br />and in'aacordanee with subsection two (2) of section 59.99 of the Wisconsin Statutes
<br />as amended by the laves of 1935.
<br />Powers and Duties
<br />1. The board ''shall meet "at the call of the chairman; and at such other times as'
<br />the board may determine, at a fixed timc',and place.. '
<br />2. All meetings of the board shall be open to the public. '
<br />3. The board shall koop minutes of its procoodings showing vote of 'each momber
<br />upon each question, or, if absent or failing'to'vote,, indicating such fact,•and
<br />shall keep records of its examinations and other official actions,' all of which.
<br />shall be- immediately filed in the office of tho'board and shall be a public rocord.
<br />4. -Tho board shall have power to 'call on any other county departments.for assis-
<br />tance in-tho performance of its duties•and it shall be the duty of such other,
<br />departments to render all such assistanco'as may be reasonably required.
<br />5. The board may adopt such rules as are necessary to carry into effect the
<br />regulations of the county board.
<br />6. In the case of all appeals, the board of adjustment shall call upon the county
<br />park commissions for all information 'pertinent to the decision appealed from.
<br />Appeals
<br />Appeals,to the board of adjustments may be taken by any person aggrio,ved or
<br />by any officer, dopartmont, board or bureau of -Dane County affected by any decision
<br />of the administrative officer. Such appeals shall bb taken within a reasonable
<br />time, as provided by the rules of tho' boars: of adjustment, by filing with the
<br />officer from whom the appeal is talcon and •v °rith the board of adjustment a notice
<br />of appeal specifying the grounds thereof. The officer from whom the appoal'.is
<br />taken shall ' forthwith transmit to the board of adjustment all the papers .consti-
<br />toting the record upon which the action -appealed from was taken.
<br />An appeal shall stay all procoodings An furtherance of the action appealed from,
<br />unless the, officer from whom the appeal is taken shall certify to the board of
<br />adjustment after the notice of appeal shall havo'beon filed with him by reason of
<br />facts stated in.the certificate a stay would -cause imminent'peril to.life or
<br />property. In, such case, the proceedings shall not be stayed othenvise than by a
<br />restraining order, which may be granted by the board of adjustment or by a court
<br />of record on application or notico- to the officer from whom the appeal is taken
<br />and on due cause shown.
<br />Tho` board of adjustment shall fix' a reasonable time for the hearing of• the
<br />appoal, give public notice thereof, as well as due notice to the parties in interest,,
<br />and decide the same within a roasonablo time. Upon- the•hoaring, any party may
<br />appear in person or by agent or by attorney.
