ction 10.20 Junk or Salvage Yards <br /> Section 10.21 Non-Conforntings Uses <br /> • <br /> (b) Every such junk or salvage yard shall be surrounded by a suitable fence, not less than <br /> six (6) feet in height and having no o penings more than two (2) inches in width except for nec- <br /> essary entrances and exits. All junk and salvage must be kep within such fence but not piled <br /> against it. S uch fences shall at all times be kept in a proper state of repair. <br /> (3) License. <br /> (a) Before any premises may be used as a junk or salvage yard, the same shall be licensed. <br /> Applicati ttn for such license shall he made to the zoning supervisor, setting forth the descrip- <br /> tion <br /> of the premises to be licensed, the nature of the business and the materials to be handled, <br /> the type of construction of any buildings to be used in connection with the business, the appli- <br /> cant's name or names, officers, if any, and address of each. The application for license shall <br /> be referred to the zoning committee, which shall within a reasonable time, hold a public hearing, <br /> notice of which shall be given in at least one of the papers customarily used for the publication y <br /> of legal notices, such notice to bepublished at least twice during the period pf ten (10) days <br /> preceeding the hearing. If, after such public hearing, the zoning committee shall find that all <br /> details of the premises and buildings are in conformity to the provisions of this ordinance, and <br /> and the site is suitable for the conduct of such business, the committee shall authorize the <br /> issuance of a license. The license fee shall be ten dollars ($10.00) per year and such license <br /> shall expire on July 1 of each year. Licenses may be renewed from year to year on authorization <br /> of the committee when inspection discloses that the business is being conducted in accordance <br /> with the provivions of this ordinance. <br /> (b) Revocation of License, Upon the complaint of any interested person, or on its own motion <br /> if inspection discloses that the provisions of this ordinance are being violated, the zoning corn • <br /> mittee may hold a public hearing to determine whether a junk yard license shall be revoked, <br /> notice of such hearing to be given to all interested parties. After public hearing, the zoning <br /> committee may order such junk yard license tevoked. <br /> (c) Should any town elect to license a salvage yard by adoption of an ordinance pursuant to <br /> the provisions of Secti of 59.07 (38) of the statutes and file a copy of such ordinance with the <br /> zoning department, then the provisions of paragraphs (a) and (b) above shall not apply, but no <br /> such license shall he issued by any town for such purpose unless the area is properly zoned <br /> and unless the zoning committee, after public hearing, shall determine that the site is suitable. <br /> • when a salvage yard is licensed by the town then the responsibility of controlling such salvacge <br /> yard will rest with the town. <br /> X V II, <br /> Section 9. Sections X, XI, XIII, XIV, XV, XVI,/XVIII and XIX of the ordinance of July 20, <br /> 1938, the title to which is recited in the title to this ordinance, are hereby renumbered to be <br /> Sections 10.21 to 10.29, 'both inclusive, Dane County Ordinances, and as so renumbered are <br /> amended to read: <br /> 10.21 NON-CONFORMING 1.1SES <br /> (1) The lawful use of a building or premises existing at the time of adoption of this ordinance <br /> may be continued as a non-conforming use, but if such non-conforming use shall be discontinued <br /> for a period of one year, such non-conforming use will he deemed to have terminated and any <br /> future use shall he in conformity to the provisions of this ordinance.
