<br /> used as a non-conforming use shall be added to or structurally altered so as to increase the
<br /> facilities for such non-conforming use.
<br /> (2) Any buildinglawfully erecter{ prior to the adoption of this ordinance which does not com-
<br /> form to the requirements of this ordinance as to setback, side yards or rear yards, may he con-
<br /> - tinned in use, but any future additions or structural alterations shall conform to the provisions -
<br /> of this,ordinance.
<br /> (3) Any existing non-conforming use may be changed to another non-conforming use of a
<br /> similar or more restricted classification or to a conforming use; provided, however, that when a
<br /> use has been changed to a conforming use or a more restricted non-conforming use it may not
<br /> again be changed to a less restricted use.
<br /> 10.22 INTERPRETATION ANC APPLICATION
<br /> (1) In interpreting and applying the provisions of this ordinance they shall be held to be
<br /> minimum requirements for the promotion of health, safety, convenience, morals, comfort and
<br /> general welfare. It is not intended by this ordinance to interfere with or abrogate or annul any
<br /> casements,covenants,or similar agreements between parties, nor is it intended by this ordinance
<br /> to repeal, abrogate, annul or in any way impair or interfere with any existing provisions of law
<br /> or ordinance, or any rules, regulations or permits previously issued or adopted, or which may be
<br /> issued or adopted according to law# relating to the use, occupancy, location or height of build-
<br /> ings or premises; provided, however, that when this ordinance imposes a greater restricti rn upon
<br /> the use, occupancy, location or height of buildings or premises than imposed by such existing
<br /> • provisions of law or ordinance, or by such rules, regulations, or permits, the provisions of this
<br /> ordinance shall control.
<br /> • 10.23COMPLETION, RESTORATION OR ENLARGEMENT OF EXISTING STRUCTURES
<br /> (1) Nothing herein contained shall require any charige in the plans, construction or intended
<br /> use of a building or premises for which plans have been prepared heretofore, and the construction
<br /> of which shall have been diligently pursued within three (3) months after the effective date
<br /> of this ordinance.
<br /> (2) Nothing herein contained shall prevent the alteration, restoration or repair of any building
<br /> occupied by a non.conforming use at the effective date of this ordinance; provided, however, that
<br /> the cost of such alteration, restoration or repairs shall not during the life of the building exceed
<br /> fifty (50) per tent of the assessed valuation of such structure or building, such valuation being
<br /> that in effect for the year in which such use became non-conforming.
<br /> (3) Nothing herein contained shall prevent the restoration of a non-conforming building or
<br /> structure destroyed by fire, explosion, act of God or act of public enemy; provided, however,
<br /> that if such destruction shall exceed fifty (50) per cent of the assessed valuation of such struct-
<br /> ure f cs the year in which such destruction occurs, the future use, locati on, height, setback, rear
<br /> and side yards shall conform to this ordinance.
