Setback Provision Section 10.17 <br /> 4. On.corner lots abutting on two streets no accessory building shall be erected, <br /> moved or added to so as to be nearer to the side street than the distance required for <br /> the main.building on such street; provided, however, that for garages with entrances <br /> facing toward the side street the minimum distance from such side street shall be <br /> twenty (20) feet, When the rear lot line of the corner lot forms part of the side line <br /> of an adjoining or abutting lot, no accessory building shall be erected, moved or <br /> added to so as to be nearer such rear lot line than the side yard required for the <br /> building on the adjoining lot. <br /> (7) Lake Shore or Water Front Lots. <br /> (a) Accessory buildings on lake shore or water front lots may be located on either <br /> the street end or water front end of such lots, or both. The distance from the side <br /> line in either case shall be governed by the provisions of Section 10. 16 (6)(a); pro- <br /> vided, however, that no accessory building nay be so placed as to reduce the required <br /> side yards for the main building. The setback of such accessory building, when located <br /> on the street end of such lot, shall comply with the provisions of Section 10.17. <br /> (8) Whenever any use or construction shall require approval of site by either the <br /> zoning committee or the county board, such use shall be started, or such use shall be <br /> covered by permit within one year from the date of such approval, otherwise such <br /> alproval shall expire, provided, however, that such approval may renewed after one <br /> year without requirement of a second public hearing if the zoning committee or the <br /> county board shall so determine. <br /> Section-7. Section IX of the ordinance.of July 20, 1938, the title to which .is re- <br /> cited in the title to this ordinance, is hereby renumbered to be Section 10.17, and <br /> as so renumbered is amended to read: <br /> A <br /> 10, 17 SETBACK PROVISIONS. <br /> For the purpose of determining the distance buildings and other structures shall <br /> be set back from streets and highways, the streets and highways of Dane County are <br /> divided into-the following classes: <br /> (1) Class A Highways. <br /> (a) All state and federal highways are'hereby designated Class A highways; also <br /> county trunk S from the west city limits of the City of Madison to its intersection <br /> with the Beltline Highway. For purposes of this ordinance any highway will be con- <br /> sidered a stat? or federal highway when the route has been approved by the State High- <br /> way Commission and a relocation order filed with the county board. <br /> (b) The setback line for Class A highways shall be one hundred (100) feet from the <br /> center line of the highway or forty-two (42) feet from the right_of way line, which- <br /> ever•is greater. <br /> (c) Service roads to Class A highways distant one hundred (100) feet from the cen- <br /> ter of said highways shall be considered Class C, D or E highways for the purpose of <br /> determining the setback along said service roads. <br /> (2) Class B Highways. <br /> (a). All county trunks, except as otherwise herein provided, are hereby designated <br /> as Class B highways. For the purpose of this ordinance any road will be considered as <br /> a county trunk after it has been placed on the county trunk system by the county board <br /> and approved by the State Highway Commission, <br /> (b) The setback for Class B highways shall be seventy-five (75) feet•from the cen- <br /> ter line of such•highway or forty-two (42) feet from the right of way line, whichever <br /> is greater. <br /> -69- <br /> • <br />
