SECTION 10.25 <br />approve or deny an application for approval of site. Prior to approving <br />or recommending to the Dane County Board of Supervisors for approval, the <br />Zoning Committee shall make findings based on the evidence presented and <br />as a result of the investigation and inspection by the Zoning Committee, <br />that the standards prescribed in 10.25 (4)(g) are complied with. <br />(c) Initiation of Application: Any owner or person having a freehold interest or <br />a contractual interest in any land may file an application for approval of <br />site as prescribed by this ordinance. <br />(d) A����lication for Approval of Site: An application for approval of site shall <br />be�iled with he Dane County Zoning Supervisor on a form prescribed by the <br />Zoning Supervisor. The application shall be accompanied by plot plans, data, <br />and other material prescribed by the Zoning Committee for the proposed devel- <br />opmentin.order to enable the committee to determine that the standards set <br />forth in 10.25 (4)(g) are met. <br />(e) _Hearing on A lication: Upon receipt of the application and statement referred <br />to in 10.2 d the committee shall hold a public hearing on each application <br />for approval of site at such time and place as shall be established by the <br />committee. <br />(f), Notice of Public Hearing: Notice of the time, place, and purpose of such hearing <br />shall 'be given by pu ication of a class 2 notice under Chapter 985, Wisconsin <br />Statutes. Notice of the time, place and purpose of such public hearing shall <br />also be sent to the applicant, to the clerk of the town in which the property <br />affected is located ana owners of property in whole or in part situated 300 feet <br />from.the property affected. <br />(g) Standards: The committee shall approve or recommend approval to the Dane County <br />Board of Supervisors if it shall find: <br />(1) That the establishment, maintenance, or operation of the proposed use will <br />not be detrimental to or endanger the public health, safety, morals, <br />comfort, or general welfare, when considered in relationship to the site. <br />(2) That the proposed use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already per - <br />mitted, nor substantially diminish and impair property value within the <br />area, <br />(3) That the establishment of such uqe will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted <br />in the district, <br />(4) That adequate utilities, access roads, drainage and necessary facilities <br />have been provided, <br />(5) That adequate measures have been taken to provide ingress and egress so <br />designed to minimize traffic congestion in the public streets, and <br />(6) That the proposed use conforms to.-the applicable regulations of the dis- <br />trict in which it is located. <br />(h)- Effector Denial of Application: No application for approval of site which has <br />been denied by the Zoning Committee shall be resubmitted for a period of one <br />year from the date of said denial, except on the grounds of new evidence or <br />- 40 - <br />
