within the Yellow Zone within a reasonable time; <br />and the same deference shall be given to the <br />customers in the Yellow Zone as is given to the <br />Village's water utility customers. <br />13. The Town shall not allow any other town, village, <br />municipality, or any person, corporation or <br />organization located outside the Yellow Zone to <br />receive water service provided by the Village's <br />water system without the written consent of the <br />-Village. <br />14. No assignment, transfer, <br />lease and/or sublease of <br />this Agreement shall be made by the Town without <br />the written consent of the Village. <br />V. SANITARY SEWER SERVICE <br />A. The Town Utility District shall provide to the Village <br />and the Village agrees to accept from the Town Utility <br />District sanitary sewer services to any land within the <br />Yellow Zone that can be reasonably served by the Town <br />Utility District. A request for sanitary sewer service <br />by the Village shall be approved by the engineers <br />representing both the Village and Town. The Town <br />Utility District and Town warrant and represent that <br />its present sanitary sewer has the capacity to <br />reasonably service the Yellow Zone. The Town Utility <br />District and Town further warrant and represent that it <br />shall reserve capacity of the present sanitary sewer to <br />serve the Yellow Zone. <br />B. A request for Town Utility District sanitary sewer <br />service to be provided in the Village shall be <br />initiated through Village Board action, reduced to <br />writing and submitted to the Town Utility District <br />Clerk by the Village Clerk. Upon the Town Utility <br />District Clerk receiving such a request, the clerk <br />erk <br />shall forward it to the Town's engineer, <br />and Village's engineer who shall mutually investigate the <br />request and prepare a report setting forth the manner, <br />and the costs thereof, by which the sanitary sewer <br />services shall be provided. The joint report shall be <br />forwarded to the Clerks of the Town Utility District <br />and Village. If the Town Utility District and the <br />Village cannot agree on the best method, and the costs <br />thereof, for providing the sewer services, the final <br />decision on the method, and the costs thereof, shall be <br />made in accordance with the terms of this Agreement and <br />Date <br />7 of 14 <br />
