by arbitration as provided for Article VIII of this <br />Agreement. <br />C. All rates, charges, assessments or other costs for <br />sewer services shall be fair and equitable, and the <br />costs shall be charged to the Village property owners <br />on the same basis and in the same manner as such <br />similar costs are charged by the Town to property <br />owners in the Town. The Village shall have the right <br />of discovery as set forth in the Wisconsin Statutes on <br />Civil Procedure as to any and all methods and/or costs <br />for providing such sewer service. <br />D. Terms and conditions of sewer service: <br />1. Town Utility District shall provide, make and keep <br />in reasonable repair all of its sewers in the <br />Yellow Zone. The Town shall also provide, make <br />and keep in reasonable repair all systems, <br />connections and equipment serving or affecting <br />service to the Yellow Zone. Nothing contained <br />herein shall be construed as to • impose <br />responsibility upon any party to this Agreement to <br />maintain sewers, systems, equipment or connections <br />owned by property owner and/or by any person who <br />is not a party to this Agreement. <br />2. The Town Utility District agrees to notify the <br />Village of any emergency or vidd condition <br />to owners may <br />ay <br />affect sewage collection provided <br />land within the Yellow Zone. <br />3. The Village shall allow duly authorized engineers, <br />inspectors and/or agents of the Town Utility <br />District to make inspections of the condition <br />which is causing the emergency or affecting the <br />sewer service within the Yellow Zone. <br />4. The parties agree that Town Utility District <br />Rules, Regulations and Ordinances setting forth <br />the terms, conditions, rights and responsibilities <br />of Town Utility District customers shall be <br />equally applicable to and enforceable against <br />property owners of land laying within the Yellow <br />Zone to the extent the property actually received <br />sanitary sewer services. ,The Village shall, upon <br />written request, provide to the Town information <br />concerning the owners of property within the <br />Yellow Zone to the extent reasonably necessary to <br />Date <br />8 of 14 <br />
