ZONING ORDINANCE A-MENDtIENm NO. 2433 <br />The Dane Countv Board of Supervisors do ordain: <br />That Chapter 10 of the Dane County Code of Ordinances be amended as follows: <br />1_ Repeal ss 10.51 (b) and recreate to read as follows: <br />(b) DISTRICT BOUNDARY: The boundary of the flood plain districts and where shown, the flood - <br />way district, shall be those areas designated as A -Zones on the Flood Insurance Rate <br />Map. This map dated September 29, 1978, is the official flood plain zoning nmp for the <br />Community and has been approved by the Department of Natural Resources and the Federal <br />Insurance Administration Office (FIA) of the Federal Emergency Management Agency (FEMA) , <br />and is on file in the Office of the Zoning Administrator. <br />Repeal ss 10.51 (b) (2) and recreate to read as follows: <br />(2) Where flood profiles exist, the location of flood plain boundaries shall be determined <br />by using the scale appearing on the map. Where the conflict exists between the flood <br />plain limits listed on the maps and the actual field conditions, the elevations from the <br />water surface profile as related to actual field elevations shall be the governing factor <br />in locating regulatory flood plain limits. Disputes shall be settled according to sec- <br />tion 10.56 (c) (2) , MAPPING DISPUTES of this Ordinance <br />3. Renumber ss 10.51 (b) (3) to (4). <br />Create a new ss 10.51 (b) (3) to read as follows: <br />(3) Where no flood profiles exist, the location of the flood plain boundary line shown on the <br />map shall be determined by the Zoning Administrator based on visual on-site inspection <br />and other available information. Where there is a significant conflict between a flood <br />plain boundary illustrated on the map and the actual field conditions, the disputes shall <br />be settled according to the procedure established in section 10.56 (c) (2) , MAPPING DIS- <br />PUTES, of this Ordinance. Where a map amendment has been approved by both the County <br />Board and the Department of Natural Resources, the Zoning Administrator shall have the <br />authority to grant or deny a zoning permit. Permits for land determined to be in the flood <br />plain shall be processed in accordance with section 10.56 (d) of this Ordinance. <br />5. Amend ss 10.51 (b) (4) to read as follows: <br />(4) Compliance with the provisions of this Ordinance shall not be grounds for the removal of <br />lands from the flood plain district unless; such lands are filled to a height of at least <br />two feet above the elevation of the "regional flood" for the particular area and are con- <br />tiguous to other lands lying outside the flood plain district, approval has been granted <br />by the Department of Natural Resources pursuant to ss 10.57 of this Ordinance, and, where <br />required, an "official letter of map amendment" has been issued by the Federal In5utcanee <br />Adtn a stat ea et HURT FIA of the Federal Emergency Management Agency (FEMA) . <br />6. Amend ss 10.51 (i) (7) to read as follows: <br />(7) Navigational and Drainage Aids Such as: channels, channel markers, buoys, and other such <br />devices are permitted, provided that prior to any alteration or relocation of a watercourse <br />the Zoning Administrator shall notify adjacent communities, the Department of Natural Re- <br />sources and the Federal Iitstiranee Adxt t st at en, office of FIA of FEP.A and require the <br />applicant to secure necessary permits. The flood carrying capacity within the altered or <br />relocated portion of any watercourse shall be maintained. <br />7. Repeal ss 10.52 (b) and recreate to read as follows: <br />(b) DESCRIPTION OF DISTRICT: The Regional Floodway District shall include mapped floodway <br />areas so designated on the official flood plain zoning map as described in section 10.51 <br />(b) of this Ordinance. <br />8. Repeal ss 10.53 (b) and recreate to read as follows: <br />(b) DESCRIPTION CF DISTRICT: The regional flood fringe district shall include the A -Zones <br />so designated on the official flood plain zoning nmp as described in section 10.51 (b) <br />of this Ordinance. <br />9. Amend ss 10.53 (d) (2) b. to read as follows: <br />b.
